A great many British ” Swallows” – extended stay visitors to Spain – are seeking ways to stay longer than the allotted 90 day visit allowed by the Schengen rules which came into effect from January 2021. For any UK Passport holder, to now stay in Spain for more than 90 days, they have to apply for a VISA. There are, for swallows, two possible options a Golden Visa and Non-Lucrative Visa. HOWEVER this is an application for SETTLED residence status. Regrettably no provision has been made during the Brexit negotiations for those who want to extend their holiday but remain in Spain under the 183 days which would make them tax resident.
In compliance with EU Regulation 2018/1806 of the European Parliament and of the Council of 14 November 2018 British passport holders travelling to Schengen countries for holidays, business or to visit family do not require a visa for stays of up to 90 days in a 180 day-period, provided the visit is not for gainful activity. Please note that the 90 days will start counting from the date they enter any of the Schengen countries, including Spain.
British citizens and their family members need a visa for journeys undertaken after 31st December 2020 for the purposes of residence, studies for period larger than 90 days, work, professional, artistic or religious activities.

HOW DO I GET A RESIDENCE VISA?
For the retired or Early retired the proof of funds requirement is likely to be the biggest barrier to some people’s application, these are the figures:
Monthly proof of income must be 4 times the minimum wage (IPREM) plus 1 times the minimum wage for each dependant family member – in 2022 that amount would be 2.316,08 euros per month plus a further 579,02 euros per month for each dependant family member; so for a married couple a total of 34.741,20 euros per year. There is also the possibility to apply for the NLV with substantial savings and investments for example in stocks and shares etc .

In the case of a positive answer, the applicant must personally collect their visa within one month from the date of notification. Failure to do so, will mean that they have renounced the visa granted, and the procedure will be closed.nSome Consulates now require you to leave your Passports with them during the process and you must then provide special envelope (prepaid) for them to return the passport to you.
After obtaining the visa, the applicant has one month from the date of entry into Spain, to process the TIE – Tarjeta de Identidad de Extranjero at an Immigration Office or Police Station in the province in which they are settling.
